The lawsuit filed by outsourced Brevard County Clerk of Court employees against Mitch Needelman was dismissed today based upon a motion to made by Orlando-based attorney Michael J. Roper.
However, Orange County Circuit Court Judge Thomas Smith granted the employees twenty days to file an amended complaint.
A motion to dismiss tests the legal (not factual) sufficiency of a lawsuit and can be made upon several grounds, commonly known to lay people as “technicalities.”
The twenty days to file an amended complaint essentially gives the employees’ lawyer, Gregory W. Eisenmenger, the opportunity to re-write the lawsuit and to cure any deficiencies raised by the defense.
